New Leafreport Research Reveals More Than 50% of Delta-8 THC Hemp-Derived Products Tested Had Illegal Levels of Delta-9 THC

Hemp-derived Delta-8 THC has exploded in popularity in 2021. Touted as a “legal high,” Delta-8 products have raised concerns over their legality, safety, and accuracy.

In this report, we’re going to address these concerns through third-party testing.

We’ve previously sent CBD products to the cannabis testing lab Canalysis to see if they contained the advertised levels of CBD. We wrote about our findings in CBD market transparency report, CBD oil, drinks, edibles, topicals, and pet product reports.

Now, we’re going to extend our research to Delta-8 THC, the fastest-growing category of hemp products. We sent 38 Delta-8 products for independent testing to see if they’re safe, legal, and contained the advertised amount of Delta-8 THC. Here’s what we found.

Summary

Out of 38 tested products, only 32% (12) had the advertised amount of Delta-8 THC. The rest were off by 10.7% to 102.7% from the label.

There were also other interesting findings:

• 53% (20) of the products were over the hemp legal limit for Delta-9 THC (0.3%), containing as much as 15.2% THC
• 34% (13) of the products did not clearly list the Delta-8 content on the label or online product description
• Most of the products (68%) had less Delta-8 than advertised
• Delta-8 pre-rolls and gummies were more likely to have inaccurate Delta-8 levels than tinctures and vape products
• All of the products passed tests for heavy metals

Accuracy Rating

We measured the accuracy of Delta-8 products by comparing how much Delta-8 they were advertised to have versus the amount shown on Canalysis’ third-party lab test reports.

If the product did not clearly show the Delta-8 concentration, we used the total listed cannabinoid content or third-party test results provided by the manufacturer. A few products had none of this information, so they automatically received the worst rating.

Industry experts recommend that cannabis products should contain cannabinoid levels that are within 10% of the advertised amount.

In other words, Delta-8 products should have anywhere from 90% to 110% of the amount stated on the label to be considered accurate.

Using this 10% cutoff, we assigned each product one of four ratings to represent its accuracy:

1. A (Excellent): independent lab tests showed Delta-8 levels that were within 10% of what was stated on the label.
2. B (Decent): independent lab tests showed Delta-8 levels that were within 20% of the label.
3. C (Poor): independent lab tests showed Delta-8 levels that were within 30% of the label.
4. F (Fail): independent lab tests showed Delta-8 levels that differed from the label by more than 30%.

What Is Delta-8? Why Is It Controversial?

Delta-8-tetrahydrocannabinol (THC) is a form of THC, the main intoxicating compound in cannabis.

Most people are only familiar with Delta-9-THC, which is usually just called “THC.” Delta-8 is weaker than Delta-9-THC but can still make you high and cause other common effects such as red eyes and sleepiness.

Delta-9-THC and the cannabis plants that contain it are federally illegal. The only exception is hemp, a variety of cannabis that’s rich in CBD and has too little Delta-9-THC (0.3% or less of dry weight) to cause psychoactive effects.

However, it’s possible to make Delta-8 from CBD. In other words, Delta-8-THC products made from hemp-derived CBD offer a “legal high” as long as they contain no more than the 0.3% Delta-9 THC.

Delta-8 is controversial because legislators never expected the cannabis industry to find a way to make intoxicating products from hemp. That’s why many individual states are now banning Delta-8 to close this loophole.

Delta-8 Third-Party Testing Explained

Third-party tests are done by an independent lab to confirm the safety and potency of hemp and cannabis products.

These tests are important when shopping for CBD and Delta-8 because some products have incorrect cannabinoid levels or carry contaminants.

The most important third-party test is called a cannabinoid profile or potency test. It measures the amount of CBD, Delta-8 and Delta-9 THC, and other cannabinoids in a product.

For our report, we ordered potency and heavy metals tests. Verifying the potency of a Delta-8 product is important for several reasons:

• You want to know you’re getting exactly what you paid for
• A product with less Delta-8 than claimed will be less effective
• A product with more Delta-8 than claimed can cause unwanted side effects
• A product with over 0.3% Delta-9 THC is not only illegal but also increases the risk of side effects

Certificate of Analysis (CoA)

We bought 38 Delta-8 products and sent them to the Las Vegas-based cannabis testing lab Canalysis. The lab technicians tested them for potency and heavy metals and recorded the results in documents called certificates of analysis (CoAs).

Next, we checked if the products passed heavy metals tests and compared the amount of Delta-8 shown on the CoAs to the advertised Delta-8 content of each product. We also checked whether their Delta-9 THC levels were below the 0.3% legal limit for hemp.

To give you an example, if a company sold a tincture that should contain 300 mg of Delta-8 but the tests only showed 200 mg, that means it had 33% less Delta-8 than claimed.

This poor result would receive our F rating since you’d be getting much less Delta-8 than you paid for.

How to Read CoAs

Most CBD and Delta-8 brands publish third-party CoAs directly on their website. This way, it’s easy for you to confirm that a product is safe, reliable, and effective before buying it.

Reading a CoA may seem difficult because of the scientific jargon but it’s not that complicated. The main thing to look for is the section called “cannabinoids,” “cannabinoid profile,” “potency,” or something similar.

Here, you’ll see columns and graphs with names of cannabinoids such as CBD, Delta-8 THC, Delta-9 THC, and others, and their amounts in percentages or milligrams (mg) per milliliter (ml), gram (g), serving, unit, or the whole container.

Summary Table

Below is the summary of the test results for the 38 Delta-8 THC products we sent to Canalysis. These include tinctures, vape products, pre-rolled joints, gummies, and other edibles.

Note 1: Products with a bolded Delta-9 THC content are over the legal limit for hemp (0.3%). Those with a minus sign under the variance column contained less Delta-8 than stated on the label, while others had more.

Note 2: Products with an * were found to have illegal Delta-9-THC levels. We deleted / blurred their names because it’s possible for test results to vary due to lab conditions but kept all other information.

Disclaimer: Our report is based solely on the test findings. Test results may vary due to the natural variation of CBD levels in hemp, degradation of CBD and other cannabinoids over time, and other factors. Our findings should not be seen as conclusive, complete, error-free, or at all times methodologically or scientifically accurate.

Conclusion

We expected Delta-8 products to be less accurate than their CBD counterparts because they’re in a legal gray area. As a result, the companies offering Delta 8 have less experience than regular CBD brands and are more likely to cut corners.

Our findings confirmed our suspicions, since only 12 (32%) of the products scored an A for accuracy, while 10 (26%) got a B, 4 (10%) a C, and 12 (32%) received the worst F rating.

On top of that, about a third of the products (34%) did not clearly list the Delta-8 content on the label or the product’s online description.

Another key finding was that more than half (53%) of the products had over 0.3% of Delta-9 THC, which is the legal limit for hemp. This is quite ironic as a major selling point of Delta 8 is that it’s a legal alternative to cannabis in states where it’s illegal.

The most likely explanation for the high THC levels is insufficient refining since the process used to make Delta-8 THC from CBD produces a sizable amount of Delta-9 THC.

Another interesting discovery was that pre-rolls and gummies were less accurate than tinctures and vapes, likely because liquid products are easier to formulate.

Overall, our investigation confirmed that Delta-8 products are mostly offered by inexperienced companies looking to make a quick buck.

These products provide little information about their cannabinoid content and have a high chance of containing inaccurate Delta-8 and illegal Delta-9 THC levels. That’s why we recommend that consumers avoid Delta-8 products.

If you still want to buy one, look for brands that list the Delta-8 content, provide third-party tests to verify the Delta-8 and Delta-9 THC levels, and have been selling CBD products for at least a few years before expanding into the Delta 8 market.

Euphorium Delta 8 Gummies

Euphorium is not the most known brand out there, but does that mean its products are inaccurate? We tested its gummies, which should contain 25 mg of Delta-8 THC per piece.

Our tests revealed an actual Delta-8 content of 22.7 mg, which is 9.3% less. That falls just within the 10% cutoff we expect for an accurate hemp product, so it gets our A rating.

The tests also found 0.08% Delta-9 THC, which is within the legal limit.

Delta 8 Vape Cartridge*

This company specializes in Delta 8 products. We sent its Delta 8 vape cartridge for testing, which should contain 97% of Delta-8 THC, or about 970 mg per gram. The tests revealed an actual Delta-8 level of 907.4 mg, which is 6.5% less.

That’s a great result deserving of our A rating since it’s less than 10% of a difference from the label.

However, the tests also found that this vape cartridge contains 8.7% of Delta-9 THC, which is much higher than the 0.3% legal limit for hemp. Technically speaking, this makes the product illegal.

Delta 8 Tincture*

This tincture is from another brand specializing in Delta-8 products. It should contain 1000 mg of Delta-8 THC and our tests found 985.7 mg.

That’s only 1.4% less than the label, which is the best result we saw from any tested product and gets a solid A.

However, the tests also found 0.42% of Delta-9 THC, which is more than the 0.3% legal limit for hemp. That means this product is technically illegal.

Chill Plus Full Spectrum Delta-8 CBD Oil

Chill is a line of products offered by Diamond CBD, a brand with a wide product variety. We sent its full-spectrum Delta-8 CBD oil for testing, which should carry 500 mg of Delta-8 THC and 500 mg of CBD.

Our tests found 543.3 mg of Delta-8, which is only 8.7% higher, as well as 523 mg of CBD, which is also close to the advertised 500 mg of CBD. That’s one of the better results of our investigation.

Additionally, the tests found 0.2% Delta-9 THC, which is below the legal limit of 0.3%.

Blue Moon Hemp Delta 8 Gummies

Blue Moon Hemp is a CBD brand that recently began to offer Delta 8 products. We sent its Delta 8 gummies for testing, finding that one piece contained 22.9 mg of Delta-8 compared to the advertised amount of 25 mg.

That’s a difference of 8.2%, which is a good result that falls within the 10% cutoff for an A rating. Additionally, the Delta-9 THC levels were below the legal limit (0.04%).

Sconi Boys Delta 8 Tincture

Sconi Boys is yet another brand that offers only Delta-8 products. We looked at its tincture, which is advertised to contain 1000 mg of Delta-8 THC.

Our tests showed 942.6 mg, which is only 5.7% lower. That’s one of the best results we saw on our tests, so it’s deserving of an A rating. The tests also showed 0.27% Delta-9 THC, which is barely under the legal limit of 0.3%.

Delta 8 Cartridge*

We couldn’t find a website for this brand, so we didn’t have high expectations for its Delta-8 vape cartridge. The label says it should carry 92% Delta-8, which is equivalent to 920 mg for a 1-gram product.

The tests showed a Delta-8 content of 845.2 mg, which is 8.1% lower. That’s a good result as it meets our 10% requirement for an A rating.

However, the tests also detected 15.2% Delta-9 THC — the highest out of any product we tested. This means this vape cartridge is essentially illegal.

Delta 8 THC Vape Cartridge*

Although the label for this vape cartridge didn’t specify the Delta-8 content, the company’s posted third-party tests showed roughly 822.6 mg. Our own tests found 858.8 mg, which is 4.4% higher. That’s one of the best results in our report.

However, the company should be more clear about the Delta-8 levels of this product. More importantly, our tests found that this cartridge also contains 12.5% Delta-9 THC, which is illegal as it’s well over the 0.3% limit for hemp.

Delta 8 Disposable Vape Pen*

This product is a disposable vape pen. Although it’s not clear how much Delta-8 it should contain, the company’s own third-party tests reported 854.1 mg per gram, so we used that for the comparison.

Our test results showed 799.7 mg. That’s only 6.4% lower, which is a good result.

Having said that, our tests also detected 9.7% of Delta-9 THC, which is much higher than the 0.3% cutoff for hemp. That means this product is illegal.

Treetop Hemp Co Delta 8 Gummies

Another brand specializing in Delta-8, Treetop Hemp Co offers vape cartridges, disposables, and gummies. We sent its gummies for testing, finding that they contained 28.2 mg of Delta-8 THC per piece.

This is 6% lower than the advertised amount of 30 mg, so it gets our A rating for being less than 10% off from the label. Additionally, we only found 0.03% Delta-9 THC, which is well within the legal limit for hemp.

Utoya Delta 8 Chocolate Bar

Florida’s Utoya is one of the few brands on this report to offer both CBD and Delta-8 products. We sent its Delta 8 chocolate bar for testing.

It should carry 200 mg of Delta-8 and actually contained 208 mg, which is only 4% higher. That’s a great result that’s deserving of an A. The tests also detected 0.04% Delta-9 THC, which is within legal limits.

Holief Delta 8 Gummies

Holief is a brand offering both CBD and Delta-8 products. We sent its Delta 8 gummies for testing, showing that they contained 7.4 mg of Delta 8 instead of the advertised 8 mg.

That’s 7.3% lower but within the 10% variance we expect from accurate hemp products, so it gets our A rating. The tests also found 0.03% Delta-9 THC, which is within the legal limit for hemp.

Endocure Delta 8 Gummies

We couldn’t find much info about the brand Endocure, but the test results for its Delta 8 gummies were fairly good. The tests found 22.2 mg of Delta-8 THC per piece, which is 11.3% less than the advertised amount of 25 mg.

While that’s not accurate enough for our A rating, it gets a B for being within 20% of the label. The tests also detected 0.14% Delta-9 THC, which is within legal limits.

Vape Cartridge*

This vape cartridge is offered by a brand specializing in Delta-8 products. Our tests found that it contained 853.4 mg of Delta-8.

Unfortunately, the company doesn’t make it clear how much Delta-8 is in this product, except for saying that it weighs 1 gram.

Assuming that they mean 1 g (1000 mg) of Delta-8, that would be a difference of 14.7% from the label, which gets our B rating.

However, the tests also found 11.22% Delta-9 THC, which is significantly higher than the legal limit for hemp (0.3%).

Hemp Pre Roll*

This pre-roll product didn’t list the Delta-8 content but we did find some third-party test results showing 76.3 mg of Delta-8. Our own independent tests found 90.6 mg, which is 18.8% higher.

That’s an okay result so it gets a B rating. We think this brand can score better if they post an estimated Delta-8 amount for their pre rolls.

However, our tests also found 1.3% of Delta-9 THC, which is higher than the 0.3% legal limit for hemp.

PureKana Delta 8 Gummies

PureKana is one of few major CBD companies on this list, so we expected a good result from its Delta-8 gummies. They should carry 25 mg of Delta 8 and our tests found 22.04 mg, which is 11.8% less.

That’s a pretty good result but it falls short of the 10% cutoff for our A rating so it gets a B. The tests also found 0.03% Delta-9 THC, which is within the legal limit.

Hell Ya Delta 8 Drink Mix

We didn’t expect the best results from a drink mix, especially when it’s offered by a brand without an online presence.

It should contain 150 mg of Delta-8 but the tests found 172.4 mg, which is almost 15% higher so it gets a B. That’s actually an okay result since Delta-8 drink mixes are a rare type of product.

The tests also detected 0.13% Delta-9 THC, which is below the legal limit.

Vape Pen*

Another product by a brand without an online presence, this vape pen is advertised to contain 1 gram (1000 mg) of full-spectrum Delta-8. Our tests showed a Delta-8 content of 836.3 mg, which is 16.4% lower and gets a B.

We think this product could get an A rating because the 1000 mg likely refers to the total cannabinoid content and not only Delta-8. However, the label doesn’t provide enough information.

Our tests also detected 9.3% of Delta-9 THC, which is illegal as it’s much higher than the 0.3% limit for hemp products.

Sun State Hemp Delta 8 Tincture

Sun State Hemp is a CBD company that also offers some Delta-8 products. We looked at its Delta 8 tincture, which should have 600 mg of Delta-8 THC.

The tests found 676.2 mg, which is 12.7% more than the label. That’s not a bad result but it’s not quite enough for an A rating, so we gave it a B.

The tests also showed 0.13% Delta-9 THC, which is within the legal limit.

The Hemp Doctor D-Bombs

The Hemp Doctor offers both CBD and Delta-8 products. We tested the company’s D-bomb candy, which should carry 5 mg of Delta-8 THC per piece.

Our tests found 5.7 mg, which is 14.1% higher. Although it gets a B, we can cut the brand some slack since the small amount of Delta-8 used in these edibles means that a difference of less than a gram can significantly affect the accuracy.

The tests also found 0.03% Delta-9 THC, which is less than the 0.3% legal limit for hemp.

Delta 8 THC Disposable Vape*

This disposable vape pen didn’t list its Delta-8 content. However, we did find a third-party test posted by the manufacturer that showed 947 mg of Delta-8 per gram.

Meanwhile, our own tests discovered 846 mg of Delta-8 THC, which is 10.7% less. That’s just a tad short of the 10% cutoff we require for our A rating, so this vape gets a B.

However, the tests also found 12.7% Delta-9 THC, which is far above the 0.3% limit for hemp, making this product illegal.

Sunmed Above Delta 8 Gummies

Sunmed is a fairly popular brand known for its “Your CBD Store” franchise chain that’s found in many states. It recently expanded into the Delta-8 market so we tested its Delta-8 gummies.

They should contain 12 mg of Delta-8 and our tests found 13.8 mg, which is 15.1% higher. That’s not a bad result, especially since it’s harder to formulate products with small amounts of cannabinoids.

This was the only product we sent for testing that didn’t contain any Delta-9 THC.

Delta 8 Hemp Pre Roll*

Like most other pre-rolls we sent for testing, this one didn’t list the Delta-8 content. But according to the third-party tests posted by the manufacturer, it should contain about 168.7 mg of Delta-8.

Our independent tests showed 130.7 mg, which is 22.5% lower. That’s not the worst result out there but it’s certainly not good enough to get our best rating so it gets a C.

However, the tests also showed almost 2% of Delta-9 THC. Since the limit for hemp is 0.3%, this makes the product illegal.

Dab Sauce*

This concentrate is advertised to contain 51% Delta-8 or 510 mg per gram. Our tests found 403.5 mg of Delta-8 THC, which is 20.9% less. That falls just short of the cutoff for a B rating so it gets a C.

The tests also detected 4.9% of Delta-9 THC. Since the legal limit for hemp products is 0.3%, this concentrate is technically illegal.

Delta 8 Cartridge*

This Delta 8 vape cartridge should contain 95% Delta-8 THC (950 mg per gram).

However, the tests showed an actual amount of 686.2 mg, which is 27.8% less. That’s a poor result that gets a C rating for being more than 20% off from the label.

The tests also found 11.7% delta-9 THC, which is much higher than the 0.3% legal limit for hemp-derived products.

Delta 8 Cartridge*

This Delta-8 cartridge is advertised to contain 1100 mg of cannabinoids but it doesn’t specify if that’s all Delta-8 or not.

The third-party tests found 781 mg of Delta-8, which is 29% lower than the label. That gives it a C rating. We think this product would score better if the manufacturer specified the precise Delta-8 content.

Additionally, the tests detected almost 6% of Delta-9 THC, which is over the 0.3% limit for hemp.

Delta 8 THC Hemp Pre-Roll*

According to the third-party tests we found online, this Delta-8 pre-roll should contain 88 mg of Delta-8 THC per gram.

However, the tests we got from Canalysis showed 45.4 mg, which is 48.4% less. That’s a bad result that’s deserving of our worst F rating.

On top of that, the tests also found 0.8% of Delta-9 THC, which is higher than the 0.3% legal limit for hemp.

Dr Blaze Delta 8 Chocolate Balls

This unique edible product from the brand Dr Blaze is advertised to contain 250 mg of Delta-8 THC.

However, our tests found only 111.6 mg, which is 55.4% less. That’s a poor result that gets an F since you’re getting less than half of what you paid for.

The tests also found 0.03% Delta-9 THC, so this product is legal.

Delta 8 Hemp Pre Roll*

This pre-roll didn’t list the Delta-8 content but we found third-party tests posted by the brand, which showed 213.6 mg of Delta-8.

However, our independent tests found only 74.2 mg, which is 65.3% less. That’s a bad result deserving of an F.

The tests showed 0.7% of Delta-9 THC, which is higher than the 0.3% legal limit for hemp.

Farma Barn Delta 8 THC Gummies

These gummies should carry 25 mg of Delta-8 THC per piece but our tests found 37.1 mg.

That’s a difference of almost 50%, which falls under our F rating. While it’s nice to get more Delta-8 than what you paid for, we expect Delta-8 products to be even more accurate than CBD because they can cause intoxication.

The tests also found 0.1% THC, which is below the legal limit.

Lit Delta 8 Gummies

Lit specializes in edible, smokable, and vape CBD and Delta-8 products. Its gummies should have 25 mg of Delta 8 per piece but the tests showed 37.1 mg.

That’s almost 50% more than it should be, so it gets an F for being more than 30% off from the label.

The tests also found 0.08% THC, so this product is within the legal limit.

The Hemp Doctor Delta 8 Cosmic Rings

This is the second product we tested from the brand Hemp Doctor. These gummies should carry 30 mg of Delta-8 per piece but our tests found 42.5 mg.

That’s 41.7% higher than advertised, which is more than 30% off from the label so it gets an F. The tests also found 0.05% Delta-9 THC, which is within the legal limit.

Delta 8 Pre Roll*

This product doesn’t list the Delta-8 amount but we found third-party tests posted by the manufacturer showing about 31.7 mg.

However, our own independent tests found 16.5 mg, which is 48% lower. That’s a poor result any way you look at it so we gave it an F.

The tests also found 0.5% of Delta-9 THC, which is above the 0.3% legal limit for hemp.

Dr. Hemp Delta 8 Pre Roll

We couldn’t find much info about this Delta-8 pre roll product from the brand Dr. Hemp. Our tests detected 10.8 mg of Delta-8 but we didn’t have anything to compare it to.

It gets an F simply for not providing any information about the Delta-8 content. Our tests also found 0.21% Delta-9 THC, which is within the legal limit.

Delta 8 Gummies*

These gummies are advertised to contain 30 mg of Delta-8 per piece but the tests we got back showed an actual content of 60.8 mg, which is more than twice that amount.

That’s a solid F and the worst result we saw out of any Delta-8 product. On top of that, the tests found 0.33% of Delta-9 THC, which is slightly above hemp’s legal limit of 0.3%.

Delta 8 Flower*

This Delta-8 flower product is advertised to carry about 150 mg of Delta-8 per gram.

Our own tests found only 7.5 mg, which is 95% less. That’s one of the worst results we saw out of any product we sent for testing.

The tests also found 0.56% Delta-9 THC, which is higher than the 0.3% legal limit for hemp.

Hemp Pre Roll*
